SPORTS AND WELLNESS COMPLEX – RULES OF CONDUCT

I. GENERAL PROVISIONS

1. In the Sport and Health Complex, located at Dubysos str. 12, Klaipėda, (hereinafter – the Sports and Wellness Complex), visitors can use the large 50-metre swimming pool, 25-metre swimming pool intended for children, and for leisure – VIP bath zona (saunas and whirlpool baths). Also, they can exercise in the gym and attend group activity sessions.

2. Operator of Sports and Wellness Complex (hereinafter – the Operator) – UAB “Klaipėdos baseinas” (legal entity code 304738249, legal address Dubysos str. 12, Klaipėda, data about the company is collected and stored in the Register of Legal Entities, the company’s data processed by the SE Centre of Registers Vilnius branch).

3. Visitor – every person who has purchased a ticket or membership according to the rules set by the Operator, has received a pass or has gained access to the Sports and Wellness Complex through the entrance gates by other legitimate means set by the Operator. The conditions and procedures for acquisition, replacement and refund of tickets and membership tickets are specified in these rules (hereinafter - the Rules).

4. The Rules establish the procedures for the service of the Sports and Wellness Complex visitors (provision of services), the mandatory security, hygiene and other requirements for visitors, the rights, duties and limits of liability of the Sports and Wellness Complex Operator and visitors, terms of ticket sales and provision of additional services.

5. The Rules are published publicly and are mandatory for all visitors to the Sports and Wellness Complex, regardless of their age. Any person, before entering into a contract for the Sports and Wellness Complex services (i.e., buying a ticket or membership), must familiarize themselves with these Rules and comply with them while using the Sports and Wellness Complex services.

6. Visitor is fully responsible for their health condition and ability to use the services provided by the Sports and Wellness Complex and this is confirmed by signing the Customer’s form. Management and staff of the Sports and Wellness Complex are not responsible for the visitor’s health problems, injuries and accidents caused while visiting and using the Sports and Wellness Complex.

7. The right to use the Sports and Wellness Complex services is reserved to individuals of any age, except for the exceptions provided for in these Rules.

8. The following individuals are prohibited from entering the Sports and Wellness Complex:

  • persons with infectious diseases;
  • suffering from conjunctivitis, contagious skin diseases;
  • individuals with open wounds;
  • individuals intoxicated by alcohol, drugs or psychotropic substances;
  • individuals who do not have an electronic ticket (microchip wristband);
  • individuals with other ailments that endanger or may endanger their own or other visitors’ health and safety;
  • individuals whose behaviour poses danger to the Sports and Wellness Complex, its safety and hygienic condition or is contrary to the publicly accepted rules of good behaviour.

9. Children under 16 years of age can visit the Sports and Wellness Complex only if accompanied by adults, who are responsible for their safety. One adult may accompany up to 4 children. The adult must be over 18 years of age and take full responsibility for the supervised children’s safety, state of health, behaviour, compliance with these Rules, for the safekeeping of the children's items, secure locking of the lockers.

10. Persons with disabilities who, due to their health condition, need care by another person, can visit the Sports and Wellness Complex only when accompanied by a supervising adult person.

11. The Sports and Wellness Complex can be temporarily closed for the preventive maintenance, with a proper notice in advance.

12. Visitors must leave the gym, group activities room, sauna area and pool area 15 min. before the end of work of the Sports and Wellness Complex or immediately after the staff’s advice. Visitors must leave through the gate before the end of work of the Sports and Wellness Complex.

13. In case of any questions or doubts, visitors must address the Sports and Wellness Complex staff.

14. Visitors who have done damage to the Sports and Wellness Complex are held responsible in accordance with the laws of the Republic of Lithuania. For damage caused by minors, their parents (or guardians) or accompanying persons are responsible.

II TICKET PURCHASE PROCEDURE, PRICES

15. Ticket prices are displayed at the Sports and Wellness Complex ticket office and on the website www.klaipedosbaseinas.lt, tickets are sold at the Sports and Wellness Complex ticket office.

16. The number of tickets sold and the number of issued microchip wristbands must match the actual number of persons incoming through the entrance gate. Wristbands are not issued to children under 7 years, unless the customer requests otherwise. Operator has the right not to issue or to issue less microchip wristbands (e.g. to the groups, etc.).

17. Sale of tickets may be temporarily stopped due to technical problems or if all lockers are occupied.

18. If a person has bought a ticket or membership ticket, but decided not to use the Sports and Wellness Complex services, the money for the ticket or membership will not be refunded and not replaced with any other type of ticket.

19. For a person who has lost the membership ticket, at his/her request, a duplicate membership ticket may be issued. Duplicate prices are displayed in the price list at the reception or on the website www.klaipėdosbaseinas.lt.

20. For gross violation of these Rules, the Sports and Wellness Complex management has the right to revoke the membership.

21. In some case, such as, due to technical reasons, during major events, or due to other major causes, access to certain services of the Sports and Wellness Complex: whirlpool baths, pool, saunas, gym, group activities, etc., may be temporarily restricted. In that case, the ticket price is not recalculated and money is not refunded to the visitor.

22. Admission to the Sports and Wellness Complex for children under 4 years is free.

23. Those wishing to purchase a ticket or membership at a discount, must provide the document (flyer, card, certificate, etc.) entitling to a discount.

24. If a visitor wants to re-enter the Sports and Wellness Complex area after having left the Sports and Wellness Complex, he/she has to buy a new ticket.

25. In case of any doubts about the age of the visitor, the cashier has the right to request the visitor to provide a proof of identity.

26. Re-registration of membership is priced in the price list. Membership can be re-registered twice, at the reception.

III.MICROCHIP WRISTBAND, ITS PURPOSE AND USE

27. With a ticket/membership to the Sports and Wellness Complex sold, a microchip wristband of appropriate colour is given, which is assigned to each visitor individually.

28. Microchip wristband must be activated within the first 15 minutes by passing through the entrance gate. If the microchip wristband is not activated within 15 min., it is automatically blocked and money is not refunded to the visitor.

29. Visit Duration when purchasing only a Pool Ticket or a Membership Ticket valid – 3 hours. Visit Duration with an Unlimited Ticket or Membership Ticket is 3 hours. The exact validity period of the ticket or membership is specified in the price list at the reception or at www.klaipedosbaseinas.lt.

30. With the microchip wristband, credit is provided which can be used by the visitor to purchase additional services at the Sports and Wellness Complex. The credit limit is determined according to the existing rates.

31. Visitor who has used the credit limit and who wishes to top it up must pay the bill at the exit cashier.

32. Having received microchip wristbands, persons must enter through the entrance gate one-by-one, by touching the wristband to the scanner at the gate. The time spent in the Sports and Wellness Complex starts from the moment when the person enters through the entrance gate and is stopped when the visitor leaves through the exit gate by touching the wristband.

33. With the microchip wristband, at the Sports and Wellness Complex area, visitors can:atrakinti ir užrakinti daiktų saugojimo spintelę;

  • lock and unlock the locker;
  • purchase goods and services in the bar, rental outlet, etc.;
  • see the microchip wristband information at the Info-station;

34. If the microchip wristband is lost or its electronic part is damaged, the visitor must approach the cashier and ask the staff to block the microchip wristband.

35. Before leaving the Sports and Wellness Complex, visitors must settle their account at the cashier. Then the amount to be paid for services rendered at the Sports and Wellness Complex for the visitor and/or his/her purchases is displayed.

36. If the visitor leaves earlier without using all the allotted time, the money for the unused time is not refunded to the visitor.

37. Payment for the exceeded time at the Sports and Wellness Complex (time, not paid for when acquiring the microchip wristband) or for failing to leave before the end of the official working hours of the Sports and Wellness Complex, is done as follows:

  • if the visitor exceeds the time limit, the fee is charged: first ten minutes free of charge, for the extra time from the tenth minute calculated for each additional minute;
  • the fee is calculated according to the existing rates and payable at the cashier.

38. If a visitor cannot pay for the extra time spent or for services rendered, the money is recovered in accordance with the laws of the Republic of Lithuania.

39. Visitors who have done damage to the Sports and Wellness Complex are held responsible in accordance with the laws of the Republic of Lithuania. For damage caused by minors, their parents (or guardians) or accompanying persons are responsible.

IV. OTHER GENERAL INFORMATION

40. The Sports and Wellness Complex is open from 6:00 am to 22:00 (10:00 pm), the gym is open from 6:30 to 21:45 (9:45 pm).

41. Working hours during holidays are set by the management and announced separately. Working hours of the Sports and Wellness Complex are displayed at the reception, on the website www.klaipedosbaseinas.lt and on social networks.

42. Sports and Wellness Complex can be closed or work different hours during swimming race. Information about working hours during the race is announced on www.klaipedosbaseinas.lt and at the reception. These days are not reimbursed from the membership tickets.

43. For their safety, visitors are monitored by video cameras at the Sports and Wellness Complex area.

44. Smoking for visitors is prohibited at the Sports and Wellness Complex territory.

45. Sports and Wellness Complex is not responsible for the visitors’ personal belongings left in the Sports and Wellness Complex premises and in unlocked lockers.

46. Items left by the visitors and later found by other visitors or the Sports and Wellness Complex staff and given to the Operator, are kept for 7 (seven) calendar days.

47. When the locker is locked, red indicator lights up on the frame of the lock; when unlocked – indicator becomes inactive. Visitors must check carefully whether the locker is securely locked.

48. Each visitor has the right to use not more than one locker. Any attempt to use more than one locker is treated as breaking into someone else's locker.

49. Visitors must immediately leave the Sports and Wellness Complex if required by the staff.

50. Visitors who experience any medical complaint at the Sports and Wellness Complex must address the lifeguard-supervisor or other member of the staff.

51. Towels and other necessary items can be rented at the reception. In such case, data of the provided service is recorded in the microchip wristband. Rented items are returned after use, and the return is recorded in the microchip wristband.

V. POOL AREA RULES

52. At the Pool, visitors must wear slippers suitable for wear in a humid environment. Longer hair should be fastened with a hair tie.

53. In saunas, each visitor must have a towel or a bathrobe.

54. In the Pool, each visitor must wear swimwear (not longer than right above the knees) and its recommended to wear swim cap.

55. While swimming in lanes, it is necessary to keep to the right side of the lane.

56. Before going to the pool area and leaving it, visitors need to take a shower.

57. Working hours of the baths are 6:30 a.m. to 21:45 (9:45 pm).

58. Eating is only allowed in the recreational pool area, at the bar zone.

VI. RULES FOR THE GYM AND GROUP ACTIVITIES ROOMS

59. The visitor, before starting to use the gym or group activities facilities must make sure that his/her health condition allows him/her to attend the gym or group activities and use their specific services and facilities.

60. At the gym and group activities room, visitors must wear neat sports clothes and clean athletic shoes. It is forbidden to exercise wearing outdoor shoes, slippers, sandals, football shoes, also with no footwear at all (unless otherwise directed by the instructor). Entrance may be denied to the visitors who violate this clause.

61. Before using the equipment and facilities of the Gym, it is necessary to read through the instructions for use displayed in the Gym or on the inventory or equipment, and in case of any uncertainties, to contact the Sports and Wellness Complex staff for the necessary information; In case of uncertainty in the group activities hall, it is necessary to address the instructor.

62. While using the equipment, it is necessary to lay a towel on the exercise machines and mats.

63. For lifting of heavy weights in the gym, it is necessary to call a second person (instructor of the hall, a friend) to help.

64. After exercises, it is necessary to tidy up the workout place (fitness accessories, other gym equipment, weights should be placed in the places designated for them).

65. Equipment and other inventory of the gym and group activities room can only be used for its intended purpose. If the visitor does not know how to use the exercise machines and other gym equipment properly and safely, they must consult with the instructor or coach in the room.

66. Do not use the exercise machines that are temporarily broken, and please notify immediately the instructor in the room of the defect noticed.

67. Do not disturb other visitors of the gym or group activities room when they are using exercise machines and other inventory, do not occupy the exercise machines during the short breaks between exercises, do not leave your personal belongings on them.

68. Before you choose the load in the gym or group activities room, please make sure that it fits your personal physical abilities. Your safety and health are in your own hands. If you feel unwell or in case of injury in the gym or group activities room, report it immediately to the staff or instructor in the room. All responsibility for the visitor’s health problems, injuries and accidents caused while visiting the gym or group activities room shall be assumed by the visitor. The Sports and Wellness Complex will not reimburse the visitor for the pecuniary and non-pecuniary damage caused to their health and life when visiting the Sports and Wellness Complex, except in cases where the damage was caused by the fault of the service provider.

69. Persons under 14 years of age are not allowed to enter the gym and the group activities room and to engage in sports there. Persons from 14 to 16 years old can exercise in the gym only under the supervision of a coach or gym instructor, after receiving an individual training program and the number of personal workouts set by the coach.

VII. RIGHTS AND DUTIES OF THE VISITORS

70. Visitor has the right:

  • to use the Sports and Wellness Complex services;
  • to demand the Operator to compensate damage suffered by the visitor caused by the fault of the Operator, in accordance with the procedure prescribed by these Rules and Lithuanian legislation.

71. Visitor undertakes:

  • before starting to use the Sports and Wellness Complex services, to make sure that his/her health condition allows him/her to use these services. the negative consequences due to the failure to comply with this requirement lie with the visitor;
  • while being in the Sports and Wellness Complex and using its services, strictly adhere to the requirements set out in these Rules;
  • while being in the Sports and Wellness Complex to wear and use only the microchip wristband assigned to him/her;
  • to follow instructions of the staff regarding safety and compliance with these Rules;
  • use the exercise equipment in the gym, group activities rooms, water slides and/or pools as required by the rules of the relevant slide and/or pool.


VIII. RIGHTS AND DUTIES OF THE OPERATOR

72. Operator has the right:

  • to deny entrance to the Sports and Wellness Complex to individuals whose behaviour may disrupt the order, endanger the safety of other visitors, Sports and Wellness Complex hygiene condition and/or would be contrary to accepted public standards of behaviour;
  • to deny entrance to the Sports and Wellness Complex to individuals if they do not understand or do not agree to comply with these Rules;
  • to change at any time the list of services provided at the Sports and Wellness Complex and/or fees without prior notice;
  • remove from Sports and Wellness Complex the visitors who break the Rules, ignore the warning signs, requirements indicated on the signboards, fail to comply with staff instructions. In this case, money is not refunded to such visitors;
  • unilaterally change the Rules, making them public;
  • to deny entrance to the Sports and Wellness Complex to individuals without any explanation;
  • the Operator is entitled to organize private parties at the Sports and Wellness Complex.


IX. RECOMMENDATIONS FOR VISITORS

73. Sports and Wellness Complex Administration recommends for the visitors to assess their physical abilities and health condition (e.g., chronic diseases, injuries, pregnancy, etc.) before planning any entertainment at the Sports and Wellness Complex.

74. It is not recommended for visitors to bring expensive items and/or valuables (jewellery, watches, mobile phones, etc.) to the Sports and Wellness Complex that may be damaged due to moisture or be lost.

75. It is not recommended for visitors to use the services of the Sports and Wellness Complex wearing any type of jewellery that may cause injury to visitors themselves and/or to the Sports and Wellness Complex inventory.

X. GENERAL RULES OF CONDUCT

76. In certain places, requiring more attention and care, warning signs are posted, which must be respected.

77. It is forbidden to make noise in saunas.

78. Before entering the saunas, and after using them, it is necessary to take a shower.

79. Entry to the dry sauna is allowed only with a towel or bathrobe, which need to be laid in the sauna on wooden loungers under the entire body.

80. On the seats and loungers, it is necessary to lay a towel or a bathrobe under the entire body.

81. Slippers must be left at the entrance to the dry sauna.

XI. BANS

82. In the Sports and Wellness Complex it is prohibited:

  • to bring glass, breakable or sharp objects;
  • to bring food and beverages;
  • to bring animals;
  • to slide down stair railings, climb steel structures or otherwise tamper with inventory in the Sports and Wellness Complex;
  • to shout, whistle, falsely call on for help, run (visitor can slip and be injured), jostle;
  • to spit on the floor and in the water, to relieve oneself not in toilets;
  • to leave children under 16 years of age unattended;
  • to wear outdoor footwear, except for the area before the changing rooms;
  • to bring and use shaving or shaving tools;
  • for the visitor to use the microchip wristband assigned not to him/her;
  • to jump into the water from the edge of the pool, whirlpool baths with intention to dive;
  • for children under 3 years to swim in the pools without special diapers;
  • to bring to the saunas and to use one’s own infusions, extracts and bath brooms;
  • to pour water on the rocks in saunas;
  • to adjust devices in the saunas;
  • film and photography;
  • to pour drinks into the pools or whirlpool baths;
  • to wash clothes in the shower;
  • to drill wet clothes or bathrobes;
  • to be in the pool under the influence of alcohol, drugs and psychotropic substances.


XII. RESPONSIBILITY

83. Visitor who has done damage to the Sports and Wellness Complex, to its property, to the property and/or health of the visitors shall be held responsible in accordance with the laws of the Republic of Lithuania. For damage caused by minors or by persons with disabilities, their parents or guardians shall be held responsible.

84. If the Sports and Wellness Complex management or staff suspect that the visitor has committed an offence, police is called immediately.

85. Parents, guardians of the minors or other accompanying adult persons are responsible for ensuring that the minors or people with disabilities that came with them are familiarized with the Rules, and for their compliance with these Rules.

86. Compensation of material damage for lost or damaged inventory is estimated by the currently approved rates.

87. The visitor is fully responsible for the rented equipment and in case of the loss shall compensate the damage incurred to the Sports and Wellness Complex. In case of failure to return the rented item or in case of damage to it, the visitor pays the fine at the exit cashier according to the existing rates.

88. A visitor who has suffered pecuniary and/or non-pecuniary damage at the Sports and Wellness Complex, must report it immediately to the Sports and Wellness Complex management or employee, indicating the scene, time and circumstances of the event, people who witnessed the event. If a visitor does not comply with this condition, later submitted complaints and claims for compensation for damage to health and/or property are not dealt with.

89. The Operator does not deal with the visitor’s claims and is not responsible for pecuniary and/or non-pecuniary damages incurred by the visitor at the Sports and Wellness Complex if the customer did not comply with the requirements and/or recommendations laid down in these Rules.

90. The Operator is not responsible for the visitors’ personal belongings or for the fact that they were lost and/or partially damaged, including swimwear of the visitors that has been damaged due to chlorinated water.

91. The Sports and Wellness Complex is not responsible for the consequences that arose to health and property of the visitors or for the damage caused to a third party, and does not accept or address claims if the consequences were caused by negligence of visitors themselves, by failing to comply with these Rules, with the information provided in the warning signs and notes, and due to non-compliance with legitimate instructions of the Sports and Wellness Complex staff.
